Las necesidades de la empresa como causa de terminación del contrato de trabajo en el sistema jurídico chileno

Abstract

Starting from the current criticisms that arise to the validity for the cause of company needs, this work proposes to analyze how this cause operates within the termination of employment contract system, in order to verify the reproachable perspectives: high requirements for its configuration and its transformation as a cause of corporate eviction. To achieve these objectives, this work will analyze the functioning of the termination of employment contract system and the legal regime for this cause.A partir de las actuales críticas que se plantean a la vigencia de la causa de necesidades de la empresa, este trabajo plantea analizar cómo opera esta causa al interior del sistema de terminación del contrato de trabajo, a fin verificar las perspectivas de reproche: la de las altas exigencias en su configuración y la de su transformación en causa de desahucio empresarial. Para alcanzar dichos objetivos, en este trabajo se analizará el funcionamiento del sistema de terminación del contrato de trabajo y el régimen jurídico de esta causa.
